Can Sworn Pleadings Be Used Against You at Your Deposition?

A sworn pleading is a document that starts your lawsuit.
You are swearing that the allegations you have made are true.

In NY civil lawsuits involving accident cases, medical malpractice cases and wrongful death cases, sworn pleadings involve the summons and complaint.

The complaint is a document that sets out who you are suing and why you're suing them.

The language is intentionally vague and general.
There are specific legal reasons for keeping it that way.

However, if you put something in your pleadings that are inconsistent or incorrect, then it can be used against you during your pretrial question and answer session known as a deposition.

Your pleadings become a piece of sworn testimony.
If you later testify about that information that is markedly different from what you originally claimed, you better have a really good excuse for why that information is different.

For example, if you say you lived in the Bronx in order to start your lawsuit in the Bronx, you better have lived in the Bronx.

If it turns out that your address is not in the Bronx, you've just opened up a pandora's box of problems including whether you are credible and believable.
