On July 1, 2023, an approved special operations plan was underway on Greer's Ferry Lake. During this operation, officials were checking every boat for compliance with State and Federal boating regulations, as well as any safety violations. While conducting a special operations checkpoint, a boat with two individuals sitting on the stern without adequate railing caught the attention of the authorities. They approached the boat and made a stop. The operator of the boat was identified as [REDACTED]. [REDACTED] was informed that the two individuals in the back of the boat couldn't ride sitting on the back of the seats without a railing.

During the stop, [REDACTED] was questioned about life jackets, fire extinguisher, and throwable on the boat. Several life jackets were found on board. When asked about the fire extinguisher, [REDACTED] initially pointed to where he thought it was, but it was not there. After some searching, the fire extinguisher was located under the port bow section of the boat seat.

[REDACTED] was also asked about the (Kill Cord) engine cutoff switch lanyard, to which he responded that he had it but it must have come off when he got up from the seat. Authorities noted a strong odor of alcohol coming from the boat and observed a large trash bag on the floor with several beer cans in it. When asked if he had consumed any alcohol, [REDACTED] initially stated he had not.

Authorities then asked [REDACTED] to perform a field sobriety test, but [REDACTED] refused. He was then asked to put on a life jacket and come to the officer's vessel for further testing, to which he also refused. [REDACTED] was informed of his right to refuse but was advised that they were still going to shore.
[REDACTED] eventually complied and was transported to shore. The authorities noted that the odor of intoxicants was very strong coming from [REDACTED]. At the shore, [REDACTED] was again asked to take a test, but he refused once more. A deputy from Van Buren County Sheriff's Office was called to transport [REDACTED] to their office.
Upon arrival at the Van Buren County Sheriff's Office, [REDACTED] was read his statement of rights and asked if he understood them. [REDACTED] expressed confusion initially but then indicated understanding without agreeing to anything. [REDACTED] was offered the opportunity to take a test once again, but he refused.
[REDACTED] was cited for Boating While Intoxicated and Refusal to Submit to a Test, and received a warning for allowing people to ride on the back of the boat without proper railing.
