Around 7:37 AM on April 22, 2024, Officer Jesse Barkow with the Whitefish Bay Police Department was dispatched to a residence on a report of a Jeep which had backed onto the front porch. He arrived on scene around 7:39 AM and made contact with the residents, and they informed him that their neighbor across the street was the driver of the Jeep. Officer Barkow walked across the street and made contact with their neighbor, who was identified as Kim Marie Stevens.

He asked Kim to explain what happened, and as he was speaking with Kim, he detected the odor of alcohol. He asked Kim if she had consumed alcohol before operating the Jeep, but she denied it. Around this time, Officer Adam Warsh arrived on scene to assist. Based on his suspicion of impairment, Officer Barkow asked Kim to perform field sobriety exercises to prove that she was safe to drive.

The first field sobriety exercise involved the Horizontal Gaze Nystagmus (HGN) test, and Officer Barkow observed a lack of smooth pursuit, distinct and sustained nystagmus at maximum deviation, and the onset of nystagmus prior to 45 degrees. He did not observe vertical gaze nystagmus. The second exercise was the Walk and Turn test, and Kim failed to touch heel-to-toe on each step while taking an incorrect number of steps. The final field sobriety exercise was the One Leg Stand test. During the One Leg Stand test, Kim failed to raise her foot in the proper fashion while putting her foot down multiple times.

Based on her the car crash, the odor of alcohol, her indicators of impairment, and her inability to perform the field sobriety tests adequately, Kim was placed under arrest for operating while intoxicated (OWI). After Kim was placed under arrest, she was transported to the Whitefish Bay Police Department for further processing.

At the Whitefish Bay Police Department, Officer Barkow read Kim the Informing the Accused Form under Wisconsin’s Implied Consent Law, and she refused to submit breath samples for testing. Since she refused to submit breath samples, she was issued a Notice of Intent to Revoke Operating Privilege form. Kim was photographed and finger printed afterwards. Officer Barkow read Kim her Miranda rights, and she also refused to answer questions. After she was processed at the station, she was released to her daughter after she signed the Agreement to Undertake Responsibility form on Kim’s behalf. Kim was issued the following citations: Operating While Under the Influence 1st Offense (346.63(1)(A)) and Failure to Keep Control (346.57(2))
