The Ninth Circuit Court of Appeals has rejected Cameron and Tyler Winklevoss' challenge to their $65 million settlement with Facebook.

The 2008 settlement for $20 million in cash plus 1.25 million shares in Facebook is now estimated to be worth approximately $160 million.

The ConnectU founders were seeking to reopen their case, saying they were misled into believing Facebook shares were worth $35.90 at the time of the settlement, based on an investment made by Microsoft.

They claim they only discovered later that an internal assessment by Facebook had valued shares of the company at only $8.88.

They claim if they had known about that assessment, they would have demanded up to four times the shares they were given, which would be worth about $600 million today.

Facebook's lawyers disagreed, saying the internal valuation was just one opinion and the twins were well aware of conflicting valuations before negotiations began.

Judge Kozinski ruled: "The Winklevosses are not the first parties bested by a competitor who then seek to gain through litigation what they were unable to achieve in the marketplace. At some point, litigation must come to an end. That point has now been reached."
