Facts Found
1. Wind was 18-20, steep short waves.

2. K1 and K5 were broad reaching downwind on starboard approaching mark 2s overlapped bow to bow a few meters apart.

3. K1 reached the zone overlapped inside with K5 to leeward bow to bow with K1’s boom was about 1 meter from K5.

4. K5 sailed a course to windward of the mark and turned down at one boat length to within 1 meter of K1.

5. K1 sailed a course windward of the mark then turned down and unintentionally jibed to port to pass the mark and jibed backed to starboard to round the mark passing within 1 meter from the mark and less than 1 meter from K5

6. There was no contact between the boats, but during the jibes, K1 damaged their mast and tore their mainsail. The damage to the mainsail prevented K1 from also sailing in race 5

7. K1 retired from the race. K5 took a one turn penalty and continued to race.

Conclusion
K5, overlapped outside at the zone, failed to give mark room and broke RRS 18.2b. K1’s finishing position was made significantly worse in race 4 and subsequent races through no fault of his own by K5 breaking a rule of part 2 and satisfies RRS 62.1b. RRS 44.1b requires K5 to be disqualified because of the damage.
