What to do when the judge incorrectly notes my submissions

I talk about a recent discussion with my client.
He told me that in a quashing petition that he had filed, the judge deliberately dictated the order that he was ready to pay the disputed amount to the complainant, when he in fact refused to pay the amount and requested the judge to decide the matter on merits.
Yet on the next date of hearing, the judge dismissed his petition, not on the merits, but by stating that on the previous hearing the petitioner was ready to pay, and now he isn't, and therefore mislead the court.
I explained to him that he should have filed written submissions on the same day the first order was passed stating that he did not want to pay the complainant, and that the matter should be decided on merit.
Now if he wants to file a Special Leave Petition before the Supreme Court, he will face the additional challenge of trying to convince the Court that he had never agreed to pay the Complainant.
