About this course

The objective of this course is to help journalists against whom baseless defamation claims may (have) be(en) brought.

The course is especially relevant in the wake of the #PanamaPapers and the #PandoraPapers as many of the attorneys named in those scandals have free judicial resources at their disposal (their own law firms) to maliciously persecute journalists with baseless claims, causing them disproportionate trouble and expense, and causing a gag in discussion as the matter becomes sub judice. This constitutes an impermissible collateral objective, however, not all judicial officers may see that initially. As such, baseless defamation claims may be allowed to proceed. In English law, the intent to gag discussion is a ground on which the case can be struck out.

However, the Truth is irrepressible and will not be defeated, so we offer this course to help until said Truth prevails, as it always does in the end.
