SEALING FELONY RECORDS

Having a felony on your criminal record can severely hinder your ability to get a job and housing. Here are five things to know about getting your felony criminal record sealed in Colorado:
1) If your criminal charge was ultimately dismissed or you were acquitted at trial, then you can petition the court for a record seal immediately. There is no waiting period, and it does not matter how serious the original charge was.
2) Certain convictions can never be sealed no matter how much time has gone by. These include class 1, 2, and 3 felonies, level 1 drug felonies, sex crimes, DUIs, and domestic violence.
3) There is a three-year waiting period before you can seal class 4, 5, or 6 felonies and level 3- and 4 drug felonies. And there is a five-year waiting period before you can seal level 2 drug felonies. The waiting period doesn’t start running until after your sentence ends and the judge closes the case.
4) There is no such thing as a partial record seal. So if you have even one unsealable conviction on your record, you cannot get any of your other convictions sealed.
