Reservations to the Convention on Genocide | 1951 I.C.J. 15 (1951)

International conventions or treaties are binding agreements between sovereign states that cover important areas like human rights and trade. When a state signs or ratifies an international convention, it may do so subject to a reservation, which is basically a qualification that the state might not follow certain provisions. The International Court of Justice, or I C J, considered reservations and their legal effect in the nineteen fifty one advisory opinion Reservations to the Convention on Genocide.

The United Nations, or U N, adopted the Genocide Convention in the aftermath of World War Two and its atrocities. The convention dealt with the prevention and punishment of genocide, which was newly classified as a crime under international law. Several states ratified the convention subject to reservations that were objected to by other states, leading to a dispute regarding those reservations and their legal effect. Seeking clarity, the U N General Assembly adopted a resolution asking the I C J for an advisory opinion. The I C J concluded that it had advisory jurisdiction and granted the request.
