Cybersecurity expert Dave Hatter expressed skepticism about the policy, citing concerns over data privacy, but said he understands why it could be attractive for a business like Kroger.

"From an efficiency standpoint and from the standpoint of potentially reducing the likelihood that people are cheating the system or clerks just aren't paying attention," said Hatter.

However, he warned against scanning IDs due to the risk of data breaches.

"As a tinfoil hat-wearing cybersecurity nut, no, I'm not going to let you scan my card to buy a beer. I'm just not going to do it. The return on investment for the risk that that creates for me—I'm just not going to do it," Hatter said.

Kroger responded to inquiries about the policy change.

"Kroger is committed to following all state and federal laws when selling age-restricted products. During checkout, a valid, government-issued identification will be scanned to verify the customer’s age. No personal information is stored," said Kroger.

Despite Kroger's assurance that no personal information is stored, Hatter emphasized the importance of minimizing data exposure.

"You as a consumer are the one that always suffers as a result of these data breaches, and until we have consumer data privacy laws that basically make businesses take this seriously and have stringent rules and significant penalties, you and I as consumers are the ones who will continue to suffer as a result of this," said Hatter.

The policy does not stem from any legal requirement in Ohio, Kentucky, Indiana, or federal law. Local 12 asked why the option to manually verify a customer's age and not scan their ID, but Kroger never responded to the question.
