The first difference between patents and trade secrets is the visibility or who knows about the idea/secret. Patents are filed with the USPTO and if granted, the document is later published to the public. Trade secrets, on the other hand, are... secret! They are not shared unless under a confidentiality agreement. Secondly, if granted, patents last for 20 years after their initial filing date, while trade secrets are secret for as long as possible without an outside party discovering the secret on their own. Lastly, patents can be prevented from being replicated, where trade secrets can be reengineered, and potentially someone else could rediscover your trade secret.
