Watch as Melanie Muhlstock explains the difference between a class action lawsuit and a mass tort. Most people have heard of a class action lawsuit, but a mass tort is a lesser-known and somewhat different legal action.

Class actions are big cases involving many parties that have been injured or damaged in some way. Each claim is basically the same, and they all go through the legal system as a group, as one case against the individual or company that has injured them.

A class action can be a mass tort, but the difference is that a mass tort can be thousands or tens of thousands of individual claims that go through the legal system as a group but are not necessarily the same. Mass torts often involve drug recalls, medical device recalls or major catastrophes where everyone is injured in some way but by varying degrees. The claims are not the same, but each claim involves the same product and often the same circumstances.

Mass tort claims are often consolidated in the federal justice system through “multi-district litigation” with claims filed in various federal courts across the country, but they are ultimately litigated in front of one federal judge. This conserves legal resources, speeds up the process, and ultimately ends up being more efficient for all parties involved. Watch the video to learn more.
