A teacher won £137,000 for disability discrimination and harassment after being shamed for sickness absence related to her disability.
Senior leadership told her she had “let colleagues and students down” for being unwell, and the Headteacher suggested it was “cynical” that she returned to work just before her sick pay reduced.
The Employment Tribunal found these comments were harassment related to disability, created a humiliating and degrading environment, and were unlawful under the Equality Act 2010.
Most importantly — she represented herself as a litigant in person and still won.
This case shows:
• Employers cannot shame disabled employees for being sick
• Questioning someone’s illness can amount to harassment
• You don’t need a lawyer to hold organisations accountable
