Three landmark Bills relating to the criminal justice system to ensure justice namely the Bharatiya Nyaya Sanhita, 2023, the Bharatiya Nagarik Suraksha Sanhita, 2023 and the Bharatiya Sakshya Bill, 2023 replacing the Indian Penal Code, 1860, the Code of Criminal Procedure, 1973 and the Indian Evidence Act, 1872 were passed by both the Houses of Parliament during the Winter Session, 2023.

Does these new laws have brought about big differences in cases where women make false claims in matters like 498A (related to cruelty against married women), domestic violence (DV) cases, divorce, and maintenance under Section 125 of the Code of Criminal Procedure (CrPC).

People have been worried about women making false claims in these cases. For example, 498A was meant to protect married women from cruelty, but most of the time 498a is misued causing harassment to husband and his family members.. Similarly, laws meant to help women facing domestic violence can be misused to make false accusations, making divorce more complicated.

The new laws i.e. BNS, BNSS makes no difference to sections like 498a, DV act, Divorce and Section 125 crpc maintainence. The only new thing is that their section number has been rearranged. Rest all the contents are same or similar.
