In this video, we will explain the Right of Private Defence against the Act of an Unsound/Illness Person under Section 36 of the Bharatiya Nyaya Sanhita (BNS) 2023.

👉 According to Section 36 BNS 2023, the right of private defence can be exercised even against the acts of a person of unsound mind, intoxicated person, or a minor if such an act puts life, body, or property in danger.

⚖️ The law recognizes that although such persons may not have criminal liability due to their mental state or incapacity, their actions can still cause real harm. Therefore, an individual has the right to protect themselves or their property from such acts.
