New documents are providing more details about the shooting death of a 5-year-old girl in Durham. The shooting also injured the little girl’s cousin, who was babysitting at the time. Khloe Fennell was shot to death in July. Destiny Sidberry, who was watching Fennel, was shot seven times but survived. Brian Luster, who’s related to both of the victims, is charged with murder. The new court records document what Luster told police on video after the shooting, as well as how witnesses described the shooting in 911 calls.

Search warrants detail the scene when police arrived, saying Luster had Sidberry "in what appeared to be a headlock in one of the bedrooms."

The warrant also states police interviewed Sidberry, noting, "She said Luster was behaving strange and sweating." It also states he went to get a gun, and "said he was dying and they [victims] were coming with him," according to Sidberry. WRAL News previously reported Luster called 911 himself, saying he thought he had overdosed. Then, on the call, you can hear multiple gunshots. In an interview with police, the warrant says Luster told officers he left the home in the early morning for a methadone clinic to treat opioid addiction. He then took a bus back to the home. Luster’s attorney is trying to suppress what he said in that recorded interview, claiming Luster didn’t know his rights. Court documents say a neighbor saw him then, and noticed he was "acting strangely outside the home and the children [were] standing at the the side door."

It reveals the neighbor called the police. It’s not clear if they responded to that initial call.

The warrants say Luster told investigators he remembers calling 911 and thinking he was dying. He says he doesn’t remember anything after that until he was at the hospital. He’s due back in court on Oct. 12 for his next hearing.
