WHAT IS THE CRIME OF COERCION IN NEVADA?

The Nevada coercion statute (NRS 207.190) makes it unlawful for a person with the intent to compel another person to do (or abstain from doing) an act that the other person has the right to do (or abstain from doing) to:

1) use violence or inflict injury upon the other person, his/her family, or property (or threatens such violence or injury), or
2) deprive the person of any tool, implement or clothing (or hinder the person in the use thereof), or
3) attempt to intimidate the person by threats or force.

Nevada coercion charges often involve cases where there was some sexual misconduct that falls short of sexual assault (rape). If the coercion is found to be sexually motivated, felony penalties include up to 6 years in Nevada State Prison and Nevada Sex Offender Registration. If the coercion was NOT sexually motivated but involved a battery or assault, it would still be a felony but would not require Nevada Sex Offender Registration. Otherwise, if the coercion was NOT sexually motivated and did NOT involve battery or assault, it is prosecuted as a misdemeanor carrying up to 6 months in jail and/or up to $1,000 in fines.
