Judge Rules Home Distilling Ban Unconstitutional - Is Moonshine Legal Now?

A Federal Judge in Texas (Mark Pittman) just ruled that the federal ban on home distilling is unconstitutional. Is making moonshine at home legal now?

In the case of HOBBY DISTILLERS ASSOCIATION v. ALCOHOL AND TOBACCO TAX AND TRADE BUREAU (2024), Federal Judge, Mark Pittman, cited with the plaintiffs, awarding them declaratory relief and a permanent injunction. The HDA argued that the federal ban on home distilling is unconstitutional, as written, and exceeds the enumerated powers given to congress in the constitution. The judge agreed and has suspended these rules, provided that the federal government does not file an appeal within 14 days.
