When the COVID-19 pandemic started, the EPO began a pilot project to hold oral proceedings in opposition cases by video conference. This has been extended and is currently set to run until September 2021.

At recent Oral Proceedings, attended by Reddie & Grose attorneys Steve Howe and Christopher Smith, the Board of Appeal referred to the Enlarged Board of Appeal the question of whether it is legal to hold Oral Proceedings by video conference before the Board of Appeal without the consent of all parties.
