Combating the Biden Administration’s Title IX Regulations

On April 29, the Biden administration formally published its final regulations on Title IX of the Civil Rights Act, which prohibits discrimination on the basis of sex at federally funded schools. Among other changes, President Joe Biden redefined “sex” to mean “gender identity” and eliminated important due process protections instituted by the Trump administration.

This regulation is certain to see its day in court—likely, the Supreme Court. But on what grounds will this regulation be challenged? What course will the litigation take, and how do recent and pending Supreme Court decisions factor into the forecast? AEI’s Max Eden will be joined by a panel of experts to discuss these questions and more.
