---I was made to be only qualifying and its marks not supposed to be accounted for in the total marks for preparation of merit list, whereas, in other papers including in Paper-II condition was different.
-- In light of the above conditions, the petitioners did not put much effort in preparing for or while writing the Paper I and they had been satisfied by answering only those questions which would obtain him the qualifying marks i.e. 30.
Factual aspect-
-- Paper-I was qualifying in nature and only 30 marks was required to be obtained by the candidates.
--Paper-I was only for the purpose of assessing the working knowledge of the candidates and marks obtained therein cannot be counted in determining the merit of the candidates.
रिट कोर्ट के निष्कर्ष
तथ्यात्मक पहलू-
पेपर-I क्वालिफाइंग प्रकृति का था और उम्मीदवारों को केवल 30 अंक प्राप्त करने की आवश्यकता थी।
--पेपर-I केवल उम्मीदवारों के कार्यसाधक ज्ञान का आकलन करने के उद्देश्य से था और उसमें प्राप्त अंकों को उम्मीदवारों की योग्यता निर्धारित करने में नहीं गिना जा सकता है।
श्री वी.एस. दुबे समिति की रिपोर्ट सपठित विज्ञापन के खंड-12 यह स्पष्ट करती है कि उम्मीदवारों द्वारा 30 से अधिक प्राप्त किए गए अंक को नहीं जोड़ा जाना चाहिए और जिन उम्मीदवारों ने उस पेपर में 30 से कम अंक प्राप्त किए हैं, उन्हें अनुत्तीर्ण घोषित किया जाना चाहिए था।
केवल यह कहना कि विज्ञापन में 1050 अंकों का उल्लेख किया गया था, यह सुझाव नहीं देगा कि पेपर- I के अंक जोड़े जाने की आवश्यकता थी।
