The Federal Trade Commission (FTC) is taking a serious look at implementing strong regulations against Commercial Surveillance. These regulations are necessary because companies are using algorithms and automated systems to analyze the information they collect from consumers. Furthermore, companies are increasingly using dark patterns or marketing tactics to influence or coerce consumers into sharing their personal information. Unfortunately, the FTC's ability to deter unlawful conduct is limited because the agency lacks the authority to seek financial penalties for initial violations of the FTC Act. Therefore, stronger regulations are necessary to protect consumers from the harmful effects of commercial surveillance.
