Over the last few years, the Supreme Court has increasingly used its shadow docket to address high-profile and politically-charged issues such as immigration, election disputes, pandemic restrictions, and abortion bans. Cases on the shadow docket are unsigned and generally absent of hearings or standard opinions, yet the court has in a few instances referenced such orders in other cases. In this interview we explore the precedential value of shadow docket cases.
