While attorneys seeking unpaid fees are required to provide their clients with notice of their right to elect mandatory fee arbitration, few practitioners truly understand the process. This presentation will address the procedural rules and substantive aspects of mandatory fee arbitration. Further, attendees will learn best practices to optimize their outcomes in fee arbitration, from hearing preparation to positioning the matter for a favorable outcome if either party rejects the award.

Speakers:
Patrick M. Maloney and Gregory Smith, The Maloney Firm, APC

Patrick Maloney has represented attorneys and clients in disputes with one another for eighteen years. Mr. Maloney present sits on the State Bar Committee on Mandatory Fee Arbitration and serves as a volunteer fee arbitrator. Mr. Maloney has trained hundreds of lawyers and lay persons to serve as fee arbitrators, and has represented parties in excess of one hundred legal fee disputes.

Gregory Smith represents parties in legal fee disputes and legal malpractice actions. Mr. Smith’s caseload includes fee matters ranging from the five to seven figures of outstanding legal fees. Mr. Smith’s work in legal fee disputes encompass disagreements over contingent fees, hourly fees, conflicts, and fee splits.
