Can your Settlement Agreement be Withdrawn?

Employees are often told that they have a limited amount of time to accept a Settlement Agreement before the offer will be withdrawn. In this video, Fiona Martin, head of employment law at Martin Searle Solicitors explains why the guidance provided by the Acas Code on Settlement Agreements is important.

The Acas Code recommends that, before a Settlement Agreement is withdrawn, employees are given 10 days to:

Consider the amount of compensation offered and the terms of the Settlement Agreement
Seek independent legal advice from an employment specialist
Negotiate a higher sum of compensation if the amount offered is unfair to avoid an Employment Tribunal claim
