Congressman Merrill Cook asks John Burroughs about the classified records of the Veterans Affairs Administration.

Sgt. John Burroughs responds first by reading a portion of letter from Senator Jon Kyl's office, "Once your claim is being processed and it is determined that needed records are classified the request for those records can be made."

A staffer from Senator Kyl's office informed Burroughs that the VA has a section for any type of operation that is classified. It is up to the military leadership of that branch of military to determine whether the records can be released to the VA. The staffer had similar problems obtaining records when it came to cases involving Agent Orange or PTSD.

Rep. Merrill Cook makes the point that the medical records of Penniston and Burroughs are OWNED by these two men under both U.S. law and military law.

Rep. Cook asks for clarification on whether the classified records of the VA pertain only to individuals involved in classified operations or those who have come forward about UFO experiences.

Burroughs reiterates that requests for medical records were being stymied when dealing with PTSD or Agent Orange cases. Very few members of congress are aware of this.

Rep. Cook- If those records were handed to you today what do you think would be on those records?"

Sgt. James Penniston- "There would be a paper trail of my increasing medical condition...The opportunity that we would have this time is that we will actually say that we were exposed to radiation, and I think that would change how the doctors would look at that."

Rep. Cook- "Do you believe that the records would absolutely show that you had been exposed to radiation?"

Penniston- "The conditions that I explained to the doctors at the time will verify that, but I think that Col. Halt has also done that by issuing that letter to the VA."

Burroughs adds that a doctor had asked him if he was ever exposed to radiation when he was receiving treatment for an eye issue.

Rep. Cook- "What has been the CIA reaction to your FOIA requests?"

Patrick Frascogna- The standard response which has been termed the Glomar has been that they can neither confirm nor deny whether they know anything.

John Burroughs- "When the State Department was given a FOIA request they admitted to having records on file." The State Department has stated that the records belong to the United States Air Force. The USAF says there is no records on file.
