A final rule published by the Department of Homeland Security permits it to demand that all foreign nationals entering or departing the country be photographed and provide biometric information, such as fingerprints, facial scans, or iris scans.

✅ The purpose of the rule is to strengthen national security, prevent identity fraud, and accurately track visa overstays.
✅ It fulfills legal requirements under the Immigration and Nationality Act and post-9/11 security laws to create a complete entry-exit tracking system.
✅ The rule expands biometric collection by Customs and Border Protection to cover both arrivals and departures at all types of ports, including airports, land borders, and seaports.
✅ It removes previous limitations tied to pilot programs or specific locations, making it a nationwide system.

📌 Sixty days after publication, on December 26, 2025, the rule will go into force. Public opinions on new biometric collection techniques used at seaports, airports, and pedestrian crossings will be accepted by DHS until November 26, 2025.

📌 For U.S. citizens and lawful permanent residents, biometric and biographic records will be retained for 15 years; for nonimmigrant visitors, they will be retained for 75 years.
