The appeal by Nicklinson and Lamb relates to whether the prohibition on assisted suicide in s2(1) Suicide Act 1961 is incompatible with the appellants' Article 8 right to respect for private and family life. In the case of "Martin", the issue is whether the code published by the Director of Public Prosecutions relating to prosecutions of those who are alleged to have assisted suicide is lawful.

The Supreme Court, by a majority of seven to two dismisses the appeal brought by Mr Nicklinson and Mr Lamb. It unanimously allows the appeal brought by the DPP, and dismisses the cross-appeal brought by Martin.
