“I claim no rights to this song/video.” Copyright is the exclusive right of the creator of a work – for example, a book, music, a scientific publication or a work of art – to publish and to reproduce it. This copyright rests with the creator. The creator has the sole right to exploit the work and may impose conditions on those who wish to use or reproduce the work in any way. Fair use is a legal doctrine that promotes freedom of expression by permitting the unlicensed use of copyright protected works in certain circumstances. Section 107 of the Copyright Act lays out the statutory framework for determining fair use by providing the following four factors:

The purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes.
The nature of the copyrighted work.
The amount and substantiality of the portion used in relation to the copyrighted work as a whole.
The effect of the use upon the potential market for or value of the copyrighted work.
