The Home Buyer Rescission Period, previously referred to as the “Cooling Off Period” is new legislation that is in effect as of January 3rd, 2023 in the province of B.C. It has been implemented to ensure that home purchasers have an opportunity to conduct due diligence and decide if they really want to move forward with purchasing the property.

Key Highlights include:

Buyers will have 3 business days to back out of an accepted offer for no reason needed.
Buyers have to pay a fee of 0.25% of the purchase price to exercise their right to rescind.
The rescission period is mandatory and cannot be waived.
There are some properties that are exempt from the rescission right.
