Around 7:37 AM on April 22, 2024, a Whitefish Bay police officer was dispatched to a residence for a report of a Jeep that had backed onto the front porch. He arrived on scene around 7:39 AM, made contact with the residents, and learned that their neighbor across the street was the driver of the Jeep.

The officer walked across the street and made contact with the neighbor, identified as Kim Marie Stevens.
He asked Kim to explain what happened and detected the odor of alcohol while speaking with her. When asked if she had consumed alcohol before operating the Jeep, Kim denied it.

Around this time, another officer arrived on scene to assist. Based on his suspicion of impairment, the officer asked Kim to perform field sobriety exercises to prove she was safe to drive.

The first field sobriety test was the Horizontal Gaze Nystagmus (HGN). The officer observed signs of impairment, including lack of smooth eye movement, distinct and sustained eye jerking at maximum deviation, and eye jerking before reaching 45 degrees. He did not observe vertical eye jerking.

The second test was the Walk and Turn. Kim failed to touch heel-to-toe on each step and took an incorrect number of steps.

The final test was the One Leg Stand. Kim failed to raise her foot properly and put her foot down multiple times.

Based on the car crash, the odor of alcohol, indicators of impairment, and failure to perform the field sobriety tests adequately, Kim was arrested for operating while intoxicated (OWI). She was then transported to the Whitefish Bay Police Department for further processing.

At the police department, the officer read Kim the Informing the Accused Form under Wisconsin’s Implied Consent Law. Kim refused to provide breath samples, so she was issued a Notice of Intent to Revoke Operating Privilege form. She was photographed, fingerprinted, and read her Miranda rights, which she chose not to answer. After processing, she was released to her daughter, who signed a responsibility form. Kim received citations for Operating While Under the Influence (1st Offense) and Failure to Keep Control.
