The two federal safety and health agencies — OSHA and MSHA — are revising their silica rules and have new enforcement initiatives underway covering general industry, construction and mining (primarily cement, stone, sand and gravel operations). MSHA’s proposed rule is in final review and should be in full effect by Summer 2024. MSHA’s deviations from OSHA’s 2016 rule will impact construction and other employers who provide electrical, mechanical, delivery or other services at mines. MSHA also holds supervisors and OHS professionals personally responsible with civil penalties, for overexposures that can be anticipated. OSHA will reopen its rule to consider medical removal provisions. It also has a new emphasis program targeting companies that sell natural stone products or manufacture or install engineered counter tops.
