If your work permit is denied, can you appeal? Yes, you can appeal to the federal court. However, this is a lengthy and often difficult process. The appeal to the federal court can take 6 months to complete. The decision will only be overturned by the court if they find a clear legal error. If an error is found, they will send the application back to the immigration authorities redecide where they can choose to either accept or refuse the application again.

However, there is an alternative to appealing which is to re-apply for the work permit by providing additional evidence to address the concerns of the immigration authorities. There are cases where re-application is not possible such after a finding of misrepresentation. In the case that re-application is not possible then the individual should consider making an appeal to the federal court.
