Shah Bano, a 62-year-old Muslim woman, was divorced by her husband under Islamic law. Left without financial support, she filed a case in court seeking maintenance under Section 125 of the Criminal Procedure Code (CrPC), which applies to all citizens regardless of religion.
In 1985, the Supreme Court ruled in Shah Bano's favor, granting her maintenance and asserting that secular laws take precedence in such cases. Under political pressure, the government passed the Muslim Women (Protection of Rights on Divorce) Act, 1986, limiting divorced Muslim women's rights to maintenance under CrPC and shifting the responsibility to relatives or the Waqf board.
