Hi my name is Jason Weinstock, Nevada Work Comp attorney located here in Las Vegas, Nevada. I want to talk to you guys a little bit about the appeals process, whether this is a hearing officer level appeal, an appeals officer level appeal, district court, and what does that even mean? So the hearing officer, that's your first level appeal. That's when the insurance company issues a letter that you disagree with, whether it has to do with them denying your claim, them denying you medical treatment, them denying you financial compensation, whether that's TTD, PPD benefits. Is the first level appeal? Have 70 days from the date of that insurance company's letter to appeal that to the hearing officer. From that point, the hearing office will hear your. It's very informal. Nothing's recorded.

Typically, they're done over the phone post-COVID. So they'll call you. You'll have an opportunity to give your side. The other side will have an opportunity to give their side. And then you get the last word, and the hearing officer will then issue a decision within about two weeks. Once you get that decision, either party can appeal. You have 30 days to appeal from the date of that hearing officer's decision to the appeals office. Now, if an appeal is filed at the appeals office this process is a little bit more formal. The hearings are recorded ones it's kind of your last say before you have to go to district court and beyond on a petition for judicial review. What is a petition for judicial review? is district court and beyond reviewing the administrative court's the appeals officer's decision for an error of law or abuse of discretion. We can't amend the record. We're stuck with what we have at the appeals office level and we're just reviewing it for whether or not the appeals officer made a mistake.

These have to be filed within 30 days of the appeals officer's decision in order in whatever district court you reside in. And then from there, you can appeal that decision from district court to the Nevada Supreme Court or the Court of Appeals.
