Elmer Stewart Rhodes argued in court that the OathKeepers made preparations in anticipation of Donald Trump invoking the Insurrection Act & ordering the OathKeepers to attack the United States Congress with the intention of stopping, delaying & hindering the certification of electoral votes from the 2020 presidential election.

The OathKeepers militia is not a well-regulated militia. Regulated implies the militia has the license & permission to act on behalf of the government. OathKeepers have no such license. A well-regulated militia as described in the Second Amendment is the National Guard. Even if Donald Trump had invoked the Insurrection Act, he could not have lawfully called up the OathKeepers on a peacekeeping mission. He would have had to federalize the National Guard.
