One of the services that we offer to our membership at Americans for Fair Treatment is doing research to empower and educate teachers and other public sector employees. Last week we got a really simple question from a New York teacher: how do I opt out of the teacher’s union?

Our member wanted to know when the opt out window was, and what they needed to do to successfully opt out.

What should have been a ten-minute investigation instead took hours. We searched the New York City Department of Education website, New York State Department of Education website, the New York City teachers Union website, and the New York State teachers union website. None of them had any information about how to opt out of the union.

Now, Teachers being unable to easily get information about their rights online is a problem, but it gets worse. We also called the offices of both the departments and the unions, and all four refused to provide the requested information. Instead, they told me that the member would need to ask their local union representative how to opt out.

I want to stop for a minute and explain why I’m making these calls instead of the teacher who wants the information calling directly. First, this is a pretty basic request. I genuinely thought this would be a ten-minute task to help out. Its what we do at AFFT, we get people the education they need to make the decision that’s right for them.

Second, employees often don’t want to identify themselves to the union they are about to leave. Giving the union a heads up that they are exploring leaving the union can result in an uncomfortable meeting between the union and the employee where the union tries to pressure them into staying. Employees are under no obligation to provide a reason why they are leaving the union. It’s a personal choice.

So, when these departments direct a member to their local union, its putting employees in an unnecessarily difficult position. They’re being to either doxx themselves, giving the union a chance to exert pressure, or keep paying the union dues.

Teachers in New York deserve better – heck – everyone deserves better than this runaround.

So what’s the final answer? How do you opt out of the teacher’s union in New York state?
