What qualifies as a laneway? There is lots of confusion over laneways, in this video we dispel the mystery!

A laneway suite is a secondary dwelling that you can build at the back of a property. The maximum size is a little over 1700 square feet over two floors, but typically most are in the 800-1200 range. Built right, they can be amazing homes unto themselves. And the can generate a decent income, at more than half the cost of a similar sized condo.

So what qualifies?
All properties that back onto a city of Toronto laneway are zoned for laneway suites. But you will not be able to get permits for most of them because they do not meet the fire code. Hence the confusion and some of the complexity.

So the biggest fire code hurdle is access. The fire persons need to be able to access the laneway and bring equipment and hoses there.
• To do that that either need to go between the houses, where they will need 90cm of unobstructed clearance between the house and the property line, or between the houses if there is a limiting distance agreement. Which is an easement registered on title, approved by both parties, and mortgage companies. This also creates confusion because people see 90cm between houses and they mistakenly think that it will be approved.
• The other way to access the unit is through the laneway itself. To qualify this way the entrance of the suite needs to be not more than 90 meters from the entrance of the laneway.
• And the final requirement is that wherever the fire truck has access it needs to be 45 meters from a fire hydrant. Which is why you might spot me looking for and pacing out distances to fire hydrants.

So how big can the laneway be?
The maximum size is 8 meters x 10 meters wide, the limiting factors are:
• The width of the lot
• Setback from the laneway
• Setback from the main house. 7.5 Meters for a 2 story, 5 meters for a 1 story
• And no tree!

There are other factors that will affect the size and style of the laneway but let’s save that for when we find a property with laneway potential!
