The Chilean process to draft and adopt a new Constitution is under way after a transversal agreement of November 2019 that responded to a month of massive protests and riots. The demand for better protection of social rights is at the core of the debates, together with challenges to the current economic system installed by the 1980 Constitution adopted during Pinochet's dictatorship. About two weeks after the elections to the Constitutional Convention, the presentation looks at the tensions at play, and asks whether the constituent body is likely to overcome the path dependency of the current Constitution's economic model in favour of guaranteeing social rights in equal terms for all. This presentation by Prof. Judith Schönsteiner of Universidad Diego Portales Chile and currently a guest researcher at the Max Planck Institute for Comparative Public Law and International Law, is based on a paper that is going to be published in June.
