No person shall be deprived of his life or personal liberty except according to the Procedure Established by Law.

The three important criteria for determining the Procedure Established by Law are:
- There must be a law justifying interference with the person's life or personal liberty.
- The law should be a valid law
- The procedure laid down by the law should have been strictly followed.

If the 3 conditions are satisfied, the court will not go behind the intentions of the legislature and uphold the deprivation of the life or liberty of an individual – even if the law is unreasonable and unjust.
