Can a Child Arrangements Order (CAO) override the need for parental consent to travel? The answer is NO, unless you meet a strict exception! 🚨

Under UK law, it is a criminal offence (Child Abduction Act 1984) to take a child out of the UK without the consent of everyone who holds Parental Responsibility (PR).

🔑 THE CAO EXCEPTION (UK Law):

If your Child Arrangements Order includes an order that the child "lives with" you (sometimes called a Residence Order), then you are legally permitted to take the child out of the jurisdiction (England and Wales) for a maximum period of 28 days without the other parent's consent.

⚠️ IMPORTANT: This 28-day rule only applies if the CAO says the child lives with you. If the CAO specifies shared living or only contact/spending time with you, the exception does not apply, and you need consent or a Specific Issue Order (SIO).

Longer Travel: Any travel longer than 28 days always requires the other parent's consent or a court order.

Best Practice: Even with the 28-day right, it is always advisable to inform the other parent of the itinerary, accommodation, and contact details.

If consent is refused, you must apply to the Family Court for a Specific Issue Order (SIO) to grant temporary permission to travel.
