If you are arrested for DWI (NYS VTL 1192 (3)) and/or VTL 1192 (2)) in New York State the police will be writing a narrative (police report) to support their arrest decision. Whether this report is very detailed and long or very sketchy and short is up to each individual officer. The too long report or the too short report each suffer flaws which can be exploited by your attorney. Much like the porridge that is too hot or too cold, and unappetizing (disgusting), extreme positions of judgment (opinions) as to sobriety topple if weighted too heavily against you.
