Under Indian Penal Code Section 494, marrying another person while your first spouse is still alive — and without a legal divorce — is a criminal offence known as Bigamy. This law clearly states that a man who remarries without ending his previous marriage can face up to 7 years in prison and a fine.

This provision was later updated under the Bharatiya Nyaya Sanhita, 2023 (BNS) as Section 82(1), continuing the same punishment. The purpose of this law is to protect the sanctity of marriage and prevent deceit or exploitation within the family structure.

If the first marriage is still legally valid and no divorce decree has been granted, the second marriage will be void under Indian law. The person involved can be prosecuted by the first spouse or family members.
