Calculating the value of a personal injury settlement, car accident settlement, or any settlement for that matter is an extremely difficult thing to do.

There needs to be an available pot of money to be claimed, a tort, and damages. These conditions must be present in order for there to be a successful personal injury case.

The insurance industry fills in the gap of risk in everyday scenarios like driving. Legislators came together and forced insurance companies to supply policies to people in order to cover this gap. On a macro level, this is supposed to make everyone safer and provide recourse in the event of injuries caused by negligence.

This means that where there's insurance policies, there are pots of money to be claimed. What most good-natured but uneducated people mistakenly assume is that pursuing a negligence claim is the wrong thing to do, and there's an implicit notion lawsuits are frivolous pursuits for greedy people with victim mindsets.

The core message I have as a lawyer to potential clients is that the lawsuit is not frivolous if you were legitimately wronged by someone or their negligence, and you are in effect suing their insurance company, not them.

Just because you may sue a family member for getting injured on their property doesn't mean you have to drag them into court and ruin your relationship. You simply are making a claim against their insurance policy which they're obligated to carry.

Too many good people leave money on the table and avoid injury settlement money because they are mistakenly afraid of holding insurance companies accountable.
