After the Magistrate has taken cognizance of the offence but before framing charges, Section 207(ii) of the CrPC requires to provide the accused with a copy of the FIR. However, the CrPC does not address an accused person’s right to access the FIR before this stage, whether during or prior to the commencement of the investigation. This issue has been clarified through High Court and Honourable Supreme Court decisions, with the key ruling being in Youth Bar Association of India v. Union of India & Ors.

The Hon’ble Supreme Court of India held that an accused person is entitled to obtain a copy of the First Information Report (FIR) from the police before the stage of Section 207 of the Code of Criminal Procedure (CrPC) in the case of Youth Bar Association of India v. Union of India (2016).

In this case, the Supreme Court emphasized that FIRs should be uploaded on the official website of the police within 24 to 72 hours of their registration to ensure transparency and the rights of the accused.
