Definition of Possession:
Possession is when a person has complete control over a thing and the right to exclude others.

Modes of Acquisition of Possession:
There are three primary modes of acquiring possession:

Taking:
Possession can be acquired by physically taking the thing, even without the owner's willingness.
a. Rightful Taking of Possession: When a shopkeeper gives an item to a customer in exchange for money, it's a rightful taking of possession.
b. Wrongful Taking of Possession: If a thief steals something, it's a wrongful taking of possession.
c. Original Taking of Possession: If a person captures a wild animal that doesn't belong to anyone, it's an original taking of possession.
Delivery:
Possession can also be acquired through delivery, with the co-operation of the previous possessor.
A. Actual Delivery: Physically transferring control of an item to another person, where the deliverer may or may not recollect possession based on the transaction's nature.
B. Constructive Delivery: The transfer of possession by operation of law when actual delivery is impossible.
a. Traditio Brevi Manu: Surrendering possession to someone who already has possession of the item.
b. Attornment: Tenant acknowledging a new landlord's rights upon departure.
Operation of Law:
The law transfers possession from one person to another, such as when a person dies, and the possession of their property is transferred to their successors and legal representatives.
Kinds of Possession:

Immediate and Mediate Possession:
a. Immediate Possession: When the possessor directly relates to the thing possessed, it's immediate possession.
b. Mediate Possession: When the possession is through a third person, it's mediate possession.
First Kind: Possession is with a servant who has no right of possession over the thing.
Second Kind: Possession is with a person holding it on behalf of someone else.
Third Kind: Possession is with a person who must return the thing after a certain period.
Corporeal and Incorporeal Possession:
a. Corporeal Possession: Possession of physical or material things.
b. Incorporeal Possession: Possession of immaterial things, like copyrights.
Representative Possession:
The owner exercises possession through a servant.
Concurrent Possession:
Possession shared by two or more persons simultaneously with destructive claims.
Derivative Possession:
Lawful possession without ownership, through a contract between parties.
Constructive Possession:
Possession in law rather than in fact, where legal control exists without physical control.
Adverse Possession:
Occurs when an occupant gains legal ownership of land by openly occupying it without permission for a certain period.
Duplicate Possession:
When two parties possess the same thing without conflicting claims, usually due to a contract.
