Section 156(3) of the Criminal Procedure Code (CrPC) has been renumbered as Section 175(3) of the Bharatiya Nagarik Suraksha Sanhita (BNSS). This change only updates the section number, and the right to approach a Magistrate remains the same.
The BNSS was introduced on August 11, 2023 to replace the CrPC. It amends provisions on bail, property seizure, and the powers of police and Magistrates.
Section 156(3) of the CrPC allowed citizens to seek a Magistrate's intervention to direct police investigations if the police refused to register an FIR. This provision ensured that victims had recourse to justice even when law enforcement agencies may be unable to fulfill their duties.
Under the revised Section 175(3) of the BNSS, a Magistrate must conduct an inquiry into the complaint and consider the submissions made by the police officer before issuing an order to direct a police investigation.
