Title: Code Words and Covert Employment Discrimination: Legal Analysis and Consequences for Management!

Description:
The presentation provides a discussion of societal norms concerning “code words,” and its links to discrimination in employment, and an examination of civil rights laws in the American workplace. We discuss the laws in the United States and actual cases where judges made a decision on whether certain code words had discriminatory intent or not.
We hypothesize that dysfunctional organizational cultures tend to have an informal means of communication where certain “code words” are used to covertly discriminate toward minorities and candidates based on their gender, age, religion, appearance, or other demographics. The use of certain stereotypical “code words” can be evidence of discrimination in the workplace.
As such, managers and human resources professionals should conduct diversity audits of their organization’s culture and communication to make sure it is free from illegal “code words” as well as derogatory stereotypical remarks. We recommend that HR professionals should regularly audit their organizations’ culture of communication and continue moving toward an inclusive work environment.
