On 11/9/2024, at approximately 12:26 AM, I responded to the address of 13554 University Plaza St, Tampa, FL 33613, for an ongoing street takeover. Officers and an aviation asset with the Tampa Police Department observed a large group of cars and pedestrians gathered in the parking lot, performing burnouts, doughnuts, drifting, and engaging in a street takeover.
As I entered the parking lot and approached the group, I observed a black Dodge Charger, later confirmed to bear Florida tag RULE15, fleeing law enforcement and the takeover scene. I overtook the suspect vehicle from the rear with my emergency lights and siren activated on my marked Florida Highway Patrol vehicle, attempting to initiate a traffic stop. The driver of the suspect vehicle, later identified as *MICHAEL NUNEZ* (DOB: 02/10/2000) via his Florida Driver's License (N-238-001-71-800-0), refused to yield to my signals and continued recklessly fleeing and eluding law enforcement.
At approximately 12:27 AM, I was in pursuit of the suspect vehicle. Nunez fled through a Wendy's parking lot at a high rate of speed, making aggressive turns around blind corners. He exited the parking lot, failing to stop at a stop sign, and turned right, heading southbound on Bruce B. Downs Blvd. Nunez accelerated, continuing to elude me. At the intersection of E. Fletcher Ave, he turned right, going westbound, proceeding past a solid red traffic signal. While making this reckless maneuver, the front left tire of the suspect vehicle separated. Nunez briefly lost control of the vehicle but regained it, continuing westbound on E. Fletcher Ave, creating sparks behind him.
I continued pursuing the suspect as he turned left onto Livingston Ave, once again proceeding through an intersection while facing a solid red traffic signal. Recognizing the increased risk to the public due to Nunez's reckless driving and the lack of a tire on his vehicle, I decided to terminate the pursuit as soon as possible.
As Nunez made the turn, I seized an opportunity to end the pursuit. Using the front right of my patrol vehicle, I intentionally contacted the rear left of the suspect vehicle. Nunez regained control and turned into the Wawa parking lot, where I intentionally contacted the rear right of the suspect vehicle with my patrol vehicle. Nunez continued fleeing through the parking lot, where I once again intentionally contacted the left side of the suspect vehicle with the front right of my patrol vehicle. The suspect vehicle finally came to a stop, and I angled my patrol vehicle in front of it to prevent further flight.
Other troopers and I gave loud verbal commands to Nunez and the two other occupants at gunpoint. All three suspects were removed from the vehicle and apprehended at approximately 12:29 AM.
The front right passenger was identified as *DENIS CESAR LOZANO GONZALEZ* via his Florida Driver's License through FCIC.
The rear right passenger was identified as *RUBEN ELOY OCAMPO* by name and date of birth.
A query of FCIC/NCIC revealed that Nunez had an active failure-to-appear warrant out of Hillsborough County, Florida. The Tampa Bay Regional Communication Center (TBRCC) sent for confirmation of the warrant, which was confirmed at approximately 12:53 AM. A query of FCIC regarding passenger Lozano Gonzalez revealed that he was on probation or supervised release status for domestic battery with strangulation.
A search of the suspect vehicle revealed two medical marijuana dispensary containers with marijuana inside, located in the center console. Both containers were labeled with Lozano Gonzalez's name. Additionally, in the rear left floorboard, I located a small black bag containing a firearm and a loaded magazine. The firearm was an FN 9mm handgun (S/N: GKS0256460), and the magazine was loaded with 14 rounds of 9mm ammunition.
Post-Miranda, Ocampo and Nunez stated that Ocampo did not have any knowledge they were going to be involved in a street takeover. Therefore, Ocampo was not charged and was later released from the scene.
I transported Nunez and Lozano Gonzalez to the Hillsborough County Jail, where they were booked and processed without further incident. All events occurred in Hillsborough County, Florida.
