For you to be found guilty of indecent assault the prosecution must prove beyond reasonable doubt that there was no consent. So they must prove that, number one, the other person did not provide consent to the act, and two, that you committed the indecent act despite, A, knowing that the other person did not consent, or B, being reckless as to whether or not consent was given. Being reckless include situations where you did not care about whether the consent was given or not, or you knew that there was a possibility that consent was not given but you acted anyway. Now whether or not consent was given in any case can be assessed by looking at a range of factors; such as the relationship between you and the other person, the actions leading up to the incident, where the incident took place, how it took place, any verbal communications between you two, body language, the nature of the act itself, whether or not the other person was heavily intoxicated. If you are charged with indecent assault it is important that you get expert advice about the issue of consent, because if you honestly believe that the other person consented your lawyer should be able to push for your charge to be dropped at an early stage. If police still want to go ahead with your case your lawyers should be able to fight hard to win your case in court.
